BODYGUARD operates under a simplified VAT registration regime pursuant to applicable Bulgarian tax legislation (Article 97a of the Bulgarian VAT Act) and does not charge VAT to Customers. Accordingly, all prices displayed are final prices without VAT.
The price of products does not include delivery charges (where applicable), which are invoiced separately as indicated on the Website and calculated prior to the final validation of the Customer’s order. The total payment requested from the Customer after order validation corresponds to the total order amount, including any applicable delivery charges. The price shown in BODYGUARD’s order confirmation is the final price. Prices may change due to changes in supplier prices or in the event of promotional offers on the Website.
6. ACCOUNT CREATION
6.1. Account creation conditions
To place an order, the Customer must have an account on the Website. This requires the Customer to be of legal age (18 years or older), have the legal capacity required to enter into contracts and purchase the products offered on the Website, and use the Website in accordance with these T&C and applicable law.
6.2. Information required for account creation
To create an account, the Customer must complete the mandatory fields in the account creation form (indicated by an asterisk *). The Customer guarantees the accuracy of the information provided. For information on how BODYGUARD uses personal data, the Customer is invited to consult the Privacy Policy on the Website.
6.3. Security of login credentials
The use of a strong password is an essential condition for account protection. Login credentials are personal, confidential and non-transferable. The Customer must ensure their confidentiality and immediately request a password reset in case of loss, forgotten password, or theft. BODYGUARD cannot be held liable for any use of the account by a third party who has accessed the Customer’s login credentials.
6.4. Account deletion
At any time, the Customer may delete their account by contacting BODYGUARD Customer Service via the contact form on the Website. The Customer’s personal data associated with the account, including order history, will be retained by BODYGUARD in accordance with the retention periods indicated in the Privacy Policy.
7. ORDERS
7.1. Product selection
To place an order, the Customer selects the desired products by clicking on them from the Website and adds them to their cart. The Customer may add as many products as desired, subject to availability. At any time during selection, the Customer may view the order summary and total price, continue browsing, remove items, add a promotional code, or complete the order by clicking the “Order” button. It is the Customer’s responsibility to verify the accuracy of their order and correct any errors before clicking “Order”.
7.2. Login and Placement
Once the Customer clicks “Order”, they are asked to log in if not already done so, or to create an account if it is their first order on the Website. Once logged in, the Customer must provide a valid delivery address with all required information (exact address, access codes, floor, etc.) and a phone number for delivery contact. BODYGUARD and the carrier cannot be held liable for delivery failure due to inaccurate or incomplete information provided by the Customer. The Customer must then select a delivery method from those offered on the Website. The total order price is automatically updated based on the selected delivery method.
7.3. Payment
7.3.1. Payment methods: The following payment methods are available:
- Card payment (Visa, Mastercard) via a secure payment processor;
- Cash on Delivery (COD), where available for the destination country. A COD surcharge applies and is displayed at checkout.
Before proceeding to payment, the Customer is responsible for verifying the content and terms of their order (products, delivery address, billing address, delivery time, payment method, and total price). The Customer may still correct errors at this stage. Once these checks are complete, the Customer formally accepts these T&C and clicks “Buy and Pay” to validate the order. By clicking this button, the Customer creates an electronic signature equivalent to a handwritten signature, constituting a legally binding commitment to pay. The price is payable in full at the time of order validation. No discount linked to a promotional code, voucher, or credit not mentioned during the order is possible at this stage. BODYGUARD takes all necessary measures to ensure the security and confidentiality of data transmitted in connection with online payment.
7.3.2. Payment refusal: If payment is refused or blocked for any reason, the order will be cancelled and the sale automatically terminated.
7.3.3. Order confirmation: The sale is only final after BODYGUARD sends the Customer an order confirmation, which appears on the Website once all the steps described above are completed. A copy of the order confirmation is automatically sent to the Customer by email, materialising the conclusion of the online sale contract. If this email is not received within 48 hours of payment, the Customer must contact BODYGUARD. Once the order confirmation is sent, the order can no longer be modified.
7.3.4. Invoice: Neither the order form created online by the Customer nor the order confirmation sent by email constitutes an invoice. The invoice is sent with the order and is also available from the Customer’s account under “Order History”.
8. DELIVERY AND SHIPPING TERMS
8.1. Expected Delivery Timeframe: Orders are processed, securely packaged, and dispatched through our logistics partner (Print on Demand Ltd. / Bigarena) within 1 to 2 business days following payment verification. The standard delivery timeframe for all authorized international destinations is 3 to 4 business days from the date of dispatch. While BODYGUARD endeavors to ensure timely delivery, these timeframes are estimated and subject to courier logistics or force majeure events outside our control.
8.2. Geographic Coverage and Delivery Zones: BODYGUARD offers international shipping exclusively to the following authorized European countries and delivery zones:
| Region | Authorized Countries / Geographic Coverage |

| Northern & Baltic Europe | Sweden, Denmark, Finland, Estonia, Latvia, Lithuania |

8.3. Shipping Charges: Shipping and handling rates vary depending on the destination zone and the weight of the order. All applicable shipping charges are clearly calculated and explicitly disclosed to the Customer on the Checkout page prior to final payment processing.
9. TRANSFER OF OWNERSHIP
The transfer of ownership of ordered products to the Customer takes effect from the time of dispatch of the products. Regardless of the date of transfer of ownership, the transfer of risks of loss and deterioration shall only occur at the moment the Customer takes physical possession of the ordered products.
10. PACKAGING
Ordered products are packaged in accordance with applicable transport standards, to ensure maximum protection during delivery. The Customer undertakes to observe the same standards if they are required to return ordered products.
11. RIGHT OF WITHDRAWAL
In accordance with Article 16(e) of EU Directive 2011/83/EU on consumer rights, as transposed into Bulgarian law by the Consumer Protection Act (Закон за защита на потребителите), the right of withdrawal does not apply to the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
BODYGUARD products are food supplements supplied in sealed packaging. Accordingly, the right of withdrawal may only be exercised if the original sealed packaging remains INTACT and UNOPENED at the time the return request is made.
ONCE THE PACKAGING HAS BEEN OPENED OR UNSEALED, NO RETURN OR REFUND IS POSSIBLE ON GROUNDS OF WITHDRAWAL, REGARDLESS OF THE REASON FOR THE REQUEST. This rule applies without exception to all food supplement products sold on the Website.
For products with intact, sealed packaging, the Customer has a period of fourteen (14) calendar days from receipt of the products to notify BODYGUARD of their intention to exercise the right of withdrawal. The withdrawal request must be made in writing via the contact form on the Website, stating the order number and the references of the products being returned.
Return shipping costs are entirely borne by the Customer. Once the returned parcel is received by BODYGUARD and verified as compliant (sealed and unopened), the refund will be processed within a maximum of 10 working days, using the same payment method as the original transaction. The mere return of products without a prior written declaration, or refusal to accept delivery, shall not be considered a valid exercise of the right of withdrawal.
12. LEGAL GUARANTEES
The products comply with applicable EU and Bulgarian legislation and with the order placed by the Customer. Unless otherwise provided by applicable law, the products benefit, without additional payment, from:
- the legal guarantee of conformity for defective, damaged or non-conforming products, in accordance with EU Directive 1999/44/EC and applicable Bulgarian consumer law;
- the legal guarantee against hidden defects arising from a defect in material, design or manufacture affecting the products and rendering them unfit for use, in accordance with applicable Bulgarian law.
Any claim concerning the receipt of one or more damaged products must be submitted and all supporting documents sent within 4 days of the date of receipt of the order by the Customer.
12.1. Legal guarantee of conformity
Under the legal guarantee of conformity, the Customer has a period of two (2) years from delivery of the ordered products to take action against BODYGUARD; may choose between repair or replacement of the ordered products, subject to the cost conditions provided for by applicable law; and is not required to prove the existence of a lack of conformity of the ordered products during the twenty-four (24) months following their delivery.
12.2. Guarantee against hidden defects
The Customer may also invoke the guarantee against hidden defects. In this case, they may choose between cancellation of the sale or a reduction in the sale price, in accordance with applicable Bulgarian law.
12.3. Implementation of legal guarantees
To exercise their rights, the Customer must notify BODYGUARD in writing via the contact form on the Website within the applicable time limits. BODYGUARD will replace or refund products under guarantee that are found to be non-conforming or affected by a hidden defect. Products must be returned in their original condition (packaging, accessories, instructions, etc.). Return shipping costs will be reimbursed on presentation of supporting documents.
Refunds will be processed as soon as possible using the same payment method as the original transaction, unless expressly agreed otherwise.
BODYGUARD’s liability shall not be engaged in the following cases: non-compliance with the legislation of the country in which the products are delivered, which the Customer is responsible for verifying; improper use, negligence or failure to maintain the products by the Customer, as well as normal wear, accident or force majeure.
13. LIABILITY
BODYGUARD’s liability shall in no case be engaged in the event of non-performance or improper performance of contractual obligations attributable to the Customer, in particular when placing an order; or non-performance or delay in performance of any of BODYGUARD’s obligations resulting from force majeure or circumstances beyond its control.
Any failure in the use of the products offered on the Website shall in no case entail the liability of BODYGUARD or justify the refund of products, which the Customer expressly acknowledges and accepts.
BODYGUARD’s liability is excluded in the event of direct or indirect damage affecting goods or persons, suffered by the Customer or a third party, and resulting from, without limitation:
- negligence or fault committed by the Customer or a third party;
- allergy or other reaction caused by consumption of the products;
- natural expiry of products;
- non-compliance by the Customer with contraindications relating to product use;
- improper use of the products;
- any other external fact beyond BODYGUARD’s control.
In any event, BODYGUARD’s liability shall be expressly limited to actual, certain and direct damages.
14. RECEIPT OF PRODUCTS AND CLAIMS
Upon receipt of their order, the Customer is invited to carefully verify the condition of the products and the conformity of the delivery. In the event of a damaged or missing product, the Customer is advised to make all appropriate reservations with the carrier and to inform BODYGUARD as soon as possible, preferably within 4 calendar days of receipt, so that BODYGUARD may exercise its recourse against the carrier. Failure to report within 4 days does not deprive the Customer of their legal rights.
The Customer remains entitled to the legal guarantee of conformity and the guarantee against hidden defects, exercisable within the time limits set out in Section 12 above.
BODYGUARD Customer Service is available:
- via the contact form on the Website; or

15. ADVERTISING
BODYGUARD reserves the right to insert advertising or promotional messages on any page of the Website and in any communication to the Customer, in a form and under conditions determined solely by BODYGUARD.
16. UNFORESEEN CIRCUMSTANCES / FORCE MAJEURE
In the event of an unforeseeable change in circumstances at the time of ordering which makes performance of the contract excessively onerous, the affected party may request renegotiation of the contract, in accordance with applicable Bulgarian law and mandatory EU consumer rights legislation.
17. VALIDITY OF THE T&C
Any modification of applicable law or any decision by a competent court invalidating one or more clauses of these T&C shall not affect the validity of the T&C as a whole. Such modification or decision does not authorise the Customer to disregard the valid provisions of these T&C.
These T&C, together with the order summary transmitted to the Customer, form a contractual whole and constitute the entirety of the contractual relations between the parties.
18. AMENDMENT OF THE T&C
These T&C are precisely dated and may be modified and updated by BODYGUARD at any time, in particular in the event of changes to the Website. The applicable T&C are those available on the Website and accepted by the Customer at the time of order validation. This version supersedes all previous versions.
19. EVIDENCE CONVENTION
Unless proven otherwise, data recorded in BODYGUARD’s computer systems constitutes proof of all transactions concluded with the Customer. By accepting these T&C, the Customer undertakes not to contest the probative value of documents produced online, in particular the sale contract, the order form and the invoice, on the basis of their electronic nature.
20. WEBSITE CESSATION
BODYGUARD reserves the right to temporarily or permanently interrupt access to all or part of the Website, in particular in the event of cessation of the activity linked to the Website or in the event of insolvency proceedings.
21. ASSIGNMENT
Subject to applicable law, the Customer consents to these T&C binding them to BODYGUARD being assigned, transferred or contributed in any manner whatsoever. In the context of a transfer of the company to a third party, these T&C will be automatically transferred to the assignee.
22. LANGUAGE
These T&C are drafted in English and Bulgarian. Both the English and Bulgarian versions are equally authoritative. Versions in languages other than English and Bulgarian are translations provided for convenience only. For the purposes of interpretation of these T&C, the English and Bulgarian versions shall prevail over all translations.
23. APPLICABLE LAW / JURISDICTION
These T&C and the transactions arising from them are governed, interpreted and applied in accordance with Bulgarian law, to the extent permitted by mandatory EU consumer protection law.
In the event of a dispute relating to their interpretation or performance, BODYGUARD and the Customer will seek an amicable resolution before any legal action and will communicate all necessary information to each other for this purpose. The Customer is informed of the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution method.
Customers may submit a complaint via the European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
In the absence of an amicable resolution within two (2) months of notification of the dispute to the other party, the parties may refer the matter to the competent courts of Bulgaria.
